Affidavit

Final

A voluntary declaration of facts written down and sworn to by the declarant before an officer authorized to administer oaths (Black’s). Among other things, affidavits are drafted to obtain search warrants and to document an officer’s probable cause for making a warrantless arrest. In the administration of bail, some persons may be tempted to place a greater emphasis on this sometimes riveting recitation of “facts” and to the charge led, to the exclusion of other relevant factors used to assess risk of flight and to public safety.
