Karr v. Alaska (2020)

James Karr, Darrell Sam, and Erwin Nashoanak each appealed the denial of their applications for a second or subsequent bail review hearing. In each case, the superior court determined that the current COVID-19 pandemic was not “new information” justifying a bail review hearing under AS 12.30.006(d)(1) and declined to hold a hearing. Karr, Sam, and Nashoanak each challenged this ruling.

The Court of Appeals found that the COVID-19 pandemic qualifies as “new information” for purposes of AS 12.30.006(d)(1), and that the trial courts erred by declining to grant the Appellants a bail review hearing.
