Prosecution Without Representation - Buffalo Law Review 2011

This document examines the issue of when in the criminal justice process defendants should be given legal counsel. Defendants are frequently without counsel during the pretrial stage, which significantly impacts costs and whether or not defendants are detained. This article analyzes court cases and research in an attempt to educate the system on the importance of right to counsel at the bail stage.
